Article 1 – Definitions

In these general terms and conditions, the following definitions apply:

  • Cancellation Period: the period within which the consumer may exercise the right of withdrawal.

  • Customer: the natural person who is not acting in the course of a profession or business and who enters into a distance contract with the trader.

  • Day: calendar day.

  • Continuous Performance Contract: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligations of which extend over a longer period.

  • Durable Medium: any device that enables the consumer or trader to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information.

  • Right of Withdrawal: the option for the consumer to dissolve the distance contract within the cancellation period.

  • Trader: the natural or legal person who offers products and/or services to consumers at a distance.

  • Distance Sales Contract: a contract which, within the framework of a system organised by the trader for the distance selling of products and/or services, is concluded exclusively by the use of one or more means of distance communication up to and including the conclusion of the contract.

  • Means of Distance Communication: a method that can be used to conclude a contract without the consumer and the trader being simultaneously present in the same room.

  • Terms and Conditions: these general terms and conditions of the trader.

Article 2 – Applicability

These terms and conditions apply to every offer from the trader, to every distance contract, and to all orders concluded between the trader and the consumer.

Before a distance contract is concluded, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated at the time the contract is concluded where the terms and conditions can be consulted and that they will be sent free of charge upon request.

If the contract is concluded electronically, the terms and conditions will be made available by electronic means in such a way that the consumer can store them on a durable medium.

If there is a conflict between these terms and conditions and specific product or service conditions, the provisions most favourable to the consumer shall prevail.

 


 

Article 3 – The Offer

Every offer contains a complete and accurate description of the products and/or services offered.

Each offer clearly states:

  • The price, excluding clearance costs, any import duties and VAT: these additional costs are for the customer’s account and risk and are payable upon receipt of the goods;

  • Any shipping costs;

  • The manner in which the contract is concluded;

  • Whether the right of withdrawal applies;

  • The method of payment, delivery and performance;

  • A description of the means of distance communication used.

Images are a faithful representation; colour variations may occur.

All offers are without obligation; printing and typographical errors do not bind the trader.

 


 

Article 4 – Responsibility for Import and VAT

The customer is responsible for all import duties, VAT and clearance costs arising from the import of the ordered goods.

These costs are collected by the carrier upon receipt of the goods and are entirely for the customer’s account and risk.

The webshop does not arrange import into the Netherlands; import is handled directly via the supplier/carrier.

 


 

Article 5 – Delivery and Dispatch

Goods are dispatched directly from a third country (for example, China) by the supplier. Cherish & Co does not itself handle import or customs clearance.

The delivery time depends on processing by the supplier and the carrier; the target timeframe is a maximum of 30 days, unless agreed otherwise.

The place of delivery is the delivery address provided by the consumer.

 


 

Article 6 – Risk of Delay or Additional Costs

Upon import, delays, customs charges or other additional costs may arise. These cannot be predicted and may vary per shipment.

Delays or additional costs are entirely for the customer’s account and risk.

Cherish & Co cannot be held liable for delays or additional costs incurred by customs or the carrier.

 


 

Article 7 – The Contract

The contract is concluded at the moment the consumer accepts the offer.

After electronic conclusion, the consumer will immediately receive an order confirmation by email.

The trader adopts appropriate technical and organisational measures to secure the electronic transmission of data.

 


 

Article 8 – Right of Withdrawal and Returns

The consumer may dissolve the contract within 30 days of receipt without giving reasons.

Return shipping costs are borne by the consumer and returns must be sent directly to the supplier in China.

After withdrawal, the purchase price will be refunded within 5 working days, provided the goods are received in their original condition.

 


 

Article 9 – Prices and Payment

All prices are in euros, exclusive of VAT and import costs.

Payment must be made within 7 days of receipt of the order confirmation.

In the event of non-payment, the trader is entitled to collection costs in accordance with statutory standards.

 


 

Article 10 – Conformity and Warranty

Delivered products comply with the contract and statutory requirements.

Any manufacturer’s warranty does not affect statutory consumer rights.

Defects must be reported within 30 days of delivery.

 


 

Article 11 – Liability

The trader is liable only for direct damage up to a maximum of the invoice amount.

Liability for indirect or consequential loss is excluded.

 


 

Article 12 – Complaints Procedure

Complaints regarding performance must be submitted in writing within 7 days of discovery.

Complaints will be answered within 30 days.

Disputes may be submitted to the E-commerce Disputes Committee.

 


 

Article 13 – Applicable Law

These contracts are governed exclusively by Dutch law.
